Nakawa High Court has awarded Shs 1.3bn to
ousted Kyambogo University vice chancellor, Prof
Omolo Ndiege as damages.
Court awarded the money to Ndiege for having
been treated unfairly by the university while
handling the appointment exercise of the vice
chancellorship last year.
Justice Elizabeth Ibanda Nahamya also gave
Ndiege one week to officially hand over his
office to the university management.
Ndiege was appointed in December 2008 but at
the expiry of his contract on January 11 2014,
when asked to handover office and the
university’s properties, he instead asked the
University Council to appoint him acting vice
chancellor citing a precedence set in judiciary on
the appointment of Justice Benjamin Odoki as
acting Supreme court judge after the expiry of
his contract as Chief Justice.
Shs 700m was awarded to Ndiege as special
damages for having been kept out of office for a
period of over two years, Shs 350m as general
damages, Shs 150m as aggravated damages and
Shs 150m as punitive damages.
Court also ordered that the costs of the suit
should be paid by Kyambogo University.
Nahamya also issued 30 per cent interest rate
per annum on special damages from the date of
ruling to payment in full.
She also ordered that punitive damages should
be paid within one month from date of ruling,
while special damages should be paid by end of
June, next year.
